Info-Provisions – Search

The Info-Provisions tool is based on a review of all public Acts of New Zealand (and, in some cases, particular regulations), but excluding the Privacy Act’s IPPs and codes of practice under that Act (as they are addressed elsewhere). All Acts were reviewed for provisions that either expressly relate to the collection, use or sharing of personal information or that could be applied in a way that captures personal information. In general, provisions that relate to disciplinary hearings, tribunal and court powers, and crimes and criminal procedure (from bail, to trial, to sentencing, to parole) were excluded. The main reason for this is that disciplinary bodies, tribunals and courts usually have wide-ranging powers to request or order the production of information (including personal information) relevant to the cases before them. That is well-known and was not the focus of this site. The site’s focus has been on more or less everything other than disciplinary hearings, tribunal and court powers, and crimes and criminal procedure. Most search warrant provisions are excluded for similar reasons.
